Data Protection

autobird is based on a lot of data (more than our grandma could possibly imagine). Some data comes from dealers, workshops, and agents who offer autobird. Other data comes from drivers who use autobird. However, the majority of all data comes from the vehicle itself, for which autobird is set up.  

In advance, it should be mentioned that all processes in autobird are designed to meet the high requirements European data protection (including no transfer of data to third parties, deletion of data as soon as possible). However, because data protection is an important and extensive topic, we cover it on a separate page on data protection.

Terms of Use

The autobird system mainly consists of the autobird app (hereinafter referred to as "App"), the autobird connector device (hereinafter referred to as "Connector"), which is usually a sensor or actor connected to a thing (like a vehicle), not belonging to autobird (hereinafter referred to as "Thing"), and the autobird data centers required in the background and is offered for use by our company (hereinafter referred to as "autobird").

The autobird system can be used either by a dealer, a workshop or an agent (hereinafter referred to as "Partner"). The Partner makes the autobird system available to its own customers for use in a vehicle and is referred to in this context as a "Sponsor".

 If a customer uses the autobird system in relation to a particular Thing by means of the Connector and the App, the user will be called an "Auto-User".

General User as basis

In order to use the autobird system either as a Partner or as an Auto-User, it is first necessary to become a "General User" of the autobird system and create a user account via the App. A General User can use the autobird system in order to create one or more Partners or to work for one or more Partners. At the same time, a General User can be an Auto-User of one or more Connectors. In exceptional cases, it is also possible to be a General User without either working for a Partner or being an Auto-User in relation to a Thing. In this case, the use is limited to the management of one's own account in the App and the possibility to create a new Partner. A General User must be of legal age, legally competent and at least 18 years old. 

To register as a General User of the App, a valid email address is required. This email address is used for both registration and later login of the user. For this purpose, emails sent to this address should be receivable on the device on which the App is to be used. 

During registration as a General User, master data and a profile picture must be entered and these Terms of Use must be accepted. Upon termination, the user account will be deleted, master data and the profile picture will be deleted, unless there are legal requirements for the investigation of criminal offenses. 

General Users are obliged to provide correct information and to use a profile picture to which they have rights. It is not necessary to enter a real clear text name. However, a registered cell phone number of the General User must be entered in addition to the receivable e-mail address. 

The use of the General User can be terminated at any time by either party. The continued use of Connectors (by other Auto-Users) and the continued operation of Partners (by other General Users) remains unaffected. Termination of the use of the General User can be performed in the App.

Use as a Partner


A Partner offers the autobird system to its own customers by providing or installing a Connector at a customer’s Thing, e.g., at a customer vehicle, and thus enabling the customer to use the autobird system via the App. Through this, the partner becomes a Sponsor of the autobird system in relation to a customer Thing prepared in this way. 

The usage period during which a Partner is considered a Sponsor in relation to a Connector and a Thing is limited. It ends when one of the following conditions is met: the usage period of the Connector shown in the App ends. Or usage is extended, as offered by autobird. Or the Connector is permanently removed from the Thing. Or another Partner becomes a Sponsor for that Connector. 

To become a Partner, a General User of the App must register a dealership, workshop or agency and become an authorized user of the Partner. In the course of registration, master data and images (logos) of the Partner are entered. The Terms of Use, which have already been accepted as a General User, then also apply with regard to the use as a Partner. Only correct and authorized master data and images must be entered to represent the business. After registering the Partner, authorized users of the Partner can name further authorized users of the same partner. In addition, authorized users of the Partner can create and manage Things and Connectors for the Partner. For a Thing that is equipped with a Connector by the Partner, authorized users of the Partner can invite customers as Auto-Users to use the autobird system in relation to a Thing and a Connector. 

As a Sponsor, an autobird Partner has the ability to enter and change master data about the Thing and view status data about the Thing. Location data and movement data, on the other hand, cannot be viewed by the Partner. In addition, the autobird system offers the possibility for Partners to send messages to the App of the associated Auto-Users. Authorized users of the partner are required to exercise great care when they view Thing status data and send messages to Auto-Users of a Thing. Content of messages must be customer or Thing related and must not contain offensive or illegal elements.

The Partner's self-management in relation to authorized users of its own operation, Things and Connectors makes it necessary for each authorized user of a Partner to perform all activities with great care. The Partner's management is responsible for regularly monitoring the settings and activities in the autobird system, including master data used, images, authorized users as well as Things and Connectors. 

Both the Partner and autobird have the right to terminate the cooperation at any time. The usage period of use of Connectors used by Auto-Users is not affected by this, provided that they have been transferred to another Partner as a Sponsor. After termination of the cooperation, the data of the Dealer will be archived, provided that this is compatible with the legal data protection.

Use as Auto-User

An owner of a Thing equipped with a Connector can use the autobird system as an Auto-User. For this, it is necessary that the Auto-User first becomes a General User of the App.

If the Partner acts as a Sponsor, the Partner provides or installs a Connector and invites a customer to become an Auto-User. Afterwards, this Auto-User can use the autobird system for that Thing. If there is no Sponsor, the Auto-User installs the Connector for using the autobird system. 

When using the system as an Auto-User, master data can be maintained and status data for the vehicle can be viewed. If there is a Sponsor, this master and status data is also visible for the Sponsor. Furthermore, location data and movement data can be viewed, which are not visible to the Sponsor.

The Auto-User can respond to messages that the Sponsor sends to the Auto-User's App. In addition, the Auto-User has usual contact channels available in the App to communicate with the Sponsor.

Auto-Users can designate several further Auto-Users in relation to the Thing, with different authorization levels. Auto-Users are obliged to perform the designation of additional Auto-Users with care and not to violate any rights or laws.

The usage period of the Connector is limited as shown in the App. At the end of the usage period, the usability of the autobird system in relation to a Thing either changes into a subscription model or extension, if offered by autobird, or ends. If the usability ends, the connector remains with the Auto-User or can be returned to the current Sponsor.

An Auto-User remains a General User of the App even after the usage period of a connector and after usability of the system in relation to a Thing.

Termination of the Auto-User's use is also possible at any time before the end of the Connector's usage period. To continue using the Connector in the Thing, it can be transferred to another Partner or Auto-User beforehand. If continued operation is not desired, the Connector can be deactivated by unplugging it from the Thing. It should be noted that the Connector can still send data for a limited period of time after it has been unplugged.

This does not affect the usage period of Connectors used by Auto-Users, provided they have been handed over to another Partner as a Sponsor. After termination of the cooperation, the data of the Partner will be archived, provided that this is compatible with the legal data protection.

An Auto-User can change the Sponsor of a connector. The transfer from one Sponsor to another Partner can be initiated by the Auto-User in the app and must be supported by the new Partner.

Things with Connector

The provision or installation of a Connector in a Thing must be explained and made clear to the owners or holders of the Thing. If the installation is done by the Partner, an instruction of the owners as well as an invitation to use the autobird system as an Auto-User are required. If the Partner is aware that owners and holders of the Thing are not identical, the owner or holder must also be informed about the installation. The Partner is required to have the knowledge of the installation confirmed in order to avoid using the Thing without being informed about the presence and functionality of the Connector. If the installation is done by the Auto-User, other owners or holders of the Thing have to be instructed by the Auto-User.

Also during operation, Partners as well as Auto-Users are obliged to explain and make known the use of a Connector in the Thing to other owners or holders of the Thing, especially if they are not car users.

The explanation must include how a Connector can be deactivated by unplugging it and reactivated by plugging in again. The explanation must also include a note that the Connector can continue to send data for a limited period of time after being unplugged.

Partners are obliged to provide only Things for the use of the autobird system that are either owned by the Partner, sold by the Partner with authorization or for which the Partner has been commissioned by the legal owner of the Thing to take care of or set up the autobird system.

Auto-Users may only equip cars with the autobird system if they are authorized to make these changes to the Thing and if the owners and holders of the Thing are informed about this.

A Connector of the autobird system is designed to be connected to a Thing, for example being plugged into a dedicated "OBD2" port of a vehicle. Apart from a few, clearly labelled exceptions, a Connector only reads data from the Thing and does not interfere with the data of the Thing. Since the autobird system does not physically or electronically interfere with the Thing control system, damage to the Thing by the autobird system is conceptually impossible. Consequently, autobird assumes no liability for any damage to the Thing. Damage caused during the installation of the Connector by the Partner, e.g. scratches in the paint, must be covered by the contractual relationship between Partner and its customers. Equally, autobird assumes no liability for any damage caused by the installation of the Connector by the Auto-User.

If a Connector reaches the end of its usage period and is not extended by actively agreeing on a subscription model, the usability ends. In this case, the associated data will be deleted, unless there are legal requirements to investigate criminal activities.

Live Sharing to Anonymous Users

Auto-Users have the option to "Live Share" their location to anonymous users, e.g., to recipients in social networks. If Auto-Users make use of Live Sharing, they agree that a limited amount of data, as specified in the Data Protection / Privacy section,  will be shared with recipients who are typically not registered as General Users. Consequently, this data must therefore be considered as globally published on the Web.


Usage License, Subscription, Extension, and Termination 

On purchasing a Connector from a shop, or acquiring a Connector from a Dealer, or setting up a Connector in the App with a coupon, the Auto-User will receive a usage license to use the Connector until the end of the usage period of the Connector, as shown in the App, without further charges. Should the Auto User enter in a subscription model, subscription fees will be charged after the end of the usage period as shown in the App. It is up to autobird to offer the Auto User a subscription or other extension model after the end of the usage period as shown in the App. If this is not offered by autobird, the usage will not be extended.


General Use

autobird is committed to provide the autobird system in a secure manner and in particular to ensure that all accruing data is securely transmitted and stored, that any unauthorized use is avoided and that the autobird system is available in the best possible way.

The purchase of Connectors by the Partner or by the Auto-User is subject to separate Terms and Conditions.

autobird reserves the right to improve and change the autobird system or to restrict or discontinue it. This includes updating, functional changes and changing the scope of the App, functional changes of the Connectors and changing the autobird data centers.

Terms of use of the autobird system are accepted in their entirety and always refer to the actual use as a Partner and / or as an Auto-User. Changes to terms of use will be communicated to Partners and Auto-Users. Termination of use as a Partner or as an Auto-User is possible at any time.

The use of the autobird system is not allowed in the following countries:

Terms and Conditions

Commercially active dealers, workshops and agents (hereinafter referred to as "Partner") can purchase autobird connectors (hereinafter referred to as "Connector") as a reseller, for acting as a Sponsor, and for their own use from our company (hereinafter referred to as "autobird"). 

Furthermore, Auto-Users can purchase special product variants of autobird Connectors for private use.

With the purchase of the Connector, the Partner or the Auto-User acquires the license to use the autobird system with this Connector for a certain usage period, specified at the time of purchase, and shown in the App. In case of a so-called "Sponsor", functionalities are limited to those required by a Partner.

At the same time, the Partner acquires the right to resell the autobird system to its own customers in relation to a Thing. The autobird system offered by the Partner comprises three components: The Connector usable over a certain usage period, the service of setup in relation to a Thing, and the license to use the autobird system incl. the autobird app in the sense of an "Auto-User", see Terms of Use.

The Partner is free to set the prices of the offered autobird system to its own customers, provided that locally applicable regulations and laws are complied with.

Any terms and conditions of delivery and payment will be presented and accepted in the course of the online purchase of connectors.

Unused connectors that have not been set up for a Thing and are in their original packaging can be returned within 14 days.

In case of  private consumers, legal regulations apply regarding purchase and return, which are clearly communicated during the purchasing process.

Used connectors that have already been set up and active on a Thing cannot be returned, unless they are returned by private consumers.

For defective, damaged or perished goods the legal regulations apply.

If the purchase of autobird is brokered by an agent, the agent regularly receives a commission for this activity.

If any part of the contract in the "fine print" is invalid or illegal, the rest is still valid.
